Participation in this SharewithTCL UGC Activity (this “Promotion”) is governed by these Terms and Conditions.
The “Promoter” of this Promotion is TCL Industries Holdings Co., Ltd.(“TCL”) whose office is at 22nd Floor, TCL Technology Building, No. 17 Huifeng 3rd Road, ZhongKai Hi-Tech Development District, Huizhou City, Guangdong Province, the People's Republic of China, organizing a promotional action for people of legal age who are resident in worldwide.
References to the “Promoter” shall include all of the Promoter’s associated companies involved in this Promotion.
By entering the Promotion, the participant fully accept the provisions of present Terms and Conditions.
TCL is organizing this Promotion to promote the image of TCL, its official website (https://www.tcl.com/global/en) and TCL Account.
2. PROMOTION PERIOD
The Promotion will be activated for the users wishing to participate as of 18:00 pm. of November 18th 2022 until 24:00 pm of November 27th 2022 both included.
3. ELIGIBLE PARTICIPANTS
This Promotion is open to non-trading individual person residing in worldwide aged 18 years or over.
Legal entities and businesses are not eligible to participate in this Promotion.
Employees and immediate relatives (husband, wife, partner of a pact of civil solidarity, children, parents, grandparents and stepfamily) of any group company of the Promoter, companies associated with this Promotion and all affiliates of such companies are not eligible to participate in this Promotion.
There is no purchase or payment requirement to participate in this Promotion.
4. ENTRY OF THE PROMOTION
During the period of the Promotion, TCL will publish a certain number of posts on Facebook, inviting you to participate in the Promotion.
Multiple entries by one participant shall not be allowed.
This Promotion is open for worldwide residents.
Every participant has 1 chance to participate in the whole activity.
The time of entry will be deemed to be the time the entry is received by the Promoter.
5. RULES OF PATICIPATION
The participants must follow TCL Brand account on Facebook.
The participants should post video with #PasstheGreatness filter (Format: video) by 24:00pm of November 27th 2022 and @TCLBrand while tag #SharewithTCL and #PasstheGreatness.
6. SELECTION OF THE WINNERS
Among all participants who comply with the requirements set out in these Terms and Conditions, the top three will be selected as winners by the Promoter who has the final interpretation and right to modification based on three criteria total 30 points as follow.
1. Relevance of the participating works to the theme of the event (1-10 points)
2. The innovation of the participating works (1-10 points)
3. The inspiration of the participating works (1-10 points)
For those winners, in order to verify the qualification of the winner and deliver the prize, TCL may further collect your contact information, address, and proof of winning or qualification certificates.
The Prizes of this Promotion are as follows,

There are no cash or other prize alternatives available. The Prizes are non-transferable, non-exchangeable and cannot be sold. In the event that the Prize is unavailable due to circumstances beyond the Promoter’s control, the Promoter reserves the right to substitute Prize for a prize of equal or greater value.
The works of TOP Three Winners will be displayed in TCL Green Gallery on Facebook . Participation of Promotion conotes that Participants who are ranked TOP3 agree that his or her works will be displayed in TCL Green Gallery on Facebook.
8. CLAIMING THE PRIZE
The Facebook account of winners will be announced on the Promoter’s Facebook page.
Each winner shall, within 24 hours from notification by the Promoter, respond to accept the Prize by providing necessary personal details(i.e. full name, contact telephone number and delivery address). Failure to respond and provide necessary personal details within 24 hours will result in the Prize being forfeited by the Promoter and the Promoter shall be entitled to select an alternate winner pursuant to the rules of Promotion.
Promotor will, on its best effort, deliver the Prize to the winner within thirty (30) days after the announcement.
In the event that the winner submits incorrect details, the Prize will be forfeited by the Promoter and the Promoter shall be entitled to select an alternate winner pursuant to the rules of Promotion.
By accepting the Prize, the winner agrees to authorize TCL to use his or her account name for publicity of the result of the Promotion.
9. DISCLAIMER AND LIABILITY LIMITATION
By entering, Participants warrant and represent the following:(a) each Participant is the sole and exclusive owner of the submitted photos; (b) Participants’ submitted photos will not infringe on any proprietary rights, intellectual property rights, industrial property rights, personal or moral rights or any other rights, including without limitation, copyright, trademark, trade names, industrial designs, patent, trade secret, privacy, publicity or confidentiality obligations; (c) any third parties appearing in the submitted photos have given Participants appropriate consent to be photographed and used as permitted herein; (d) Submitted photos shall not violate any applicable laws.
Providing a submitted photo constitutes the Participant’s consent to give the Promoter a royalty-free, irrevocable, non-exclusive license to use, reproduce, publish and display such photos in whole or in part, on a worldwide basis, in any form, media for one year for purposes of implementing the Activity.
The Promoter accepts no responsibility for any late, lost, delayed, incomplete, incorrectly submitted, corrupted, illegible or misdirected entries, claims or correspondence whether due to omission, error, alteration, tampering, deletion, theft, destruction, disruption to any communication network or medium, or otherwise including those entries not received by the Promoter for any reason. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred.
In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter's ability (or that of a third party involved with the Promotion) to proceed with the Promotion on the dates and in the manner described in these Terms of entry, including but not limited to vandalism, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter's obligations in respect of the Promotion will be suspended for the duration of the event and, in addition, the Promoter may in its absolute discretion cancel the promotion and recommence it from the start on the same conditions, subject to approval of the relevant authorities.
The Promoter takes no responsibility where it is unable to contact prize winners who have not provided correct or complete contact details. If a Participant's contact details change during the promotional period, it is the participant's responsibility to notify the Promoter. A request to modify any entry information should be directed to the Promoter.
To the greatest extent permitted by law, the Promoter excludes all warranties, representations or guarantees (Warranties) regarding the Promotion and any Prizes, including any Warranties which may have been made in the course of advertising or promoting the Promotion. The conduct of the Promotion or the supply of prizes may involve third parties, and the Promoter makes no Warranties and disclaims all liability in connection with any such third parties, their acts or omissions. By entering the Promotion, a Participant releases and indemnifies the Promoter and its related bodies corporate (including the officers, employees and agents of each) from and against all actions, penalties, liabilities, claims or demands the Participant may have against the Promoter or that the Promoter may incur for any loss or damage which is or may be suffered or sustained as a direct or indirect result of an Participant entering or participating in the Promotion or winning or failing to win a Prize, or using or permitting any other person to use the Prize, except for any liability which cannot be excluded by law or which would cause any part of this clause to be void or unenforceable.
Without limiting any of the foregoing, in no circumstances will a Participant or the Promoter have any liability to the other for any loss or damage suffered which is indirect or consequential in nature, including without limitation any loss of profit, loss of reputation, loss of goodwill, or loss of business opportunity.
10. STANDARDS OF CONDUCT
TCL shall have the right to refuse any participation which includes or suggests any of the following:
- Consumption of alcohol by any person under the legal drinking age (or 18 years old if over),
- Any kind of illegal or anti-social behavior,
- Celebrities or other well-known persons, logos, copyrighted content or trademarks belonging to any third party.
- Offensive gestures, comments, or which could cause any offence based on gender, race, sexual orientation, religion or culture.
Participants are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize(s). The Promoter accepts no responsibility for any tax implications that may arise from accepting a prize. Participants are responsible for any and all expenses that they incur in entering the competition and they will not be reimbursed regardless of whether or not they win the competition.
12. PERSONAL DATA PROTECTION
The personal data you provide during this Promotion will be processed solely in accordance with the instructions contained in these Terms and Conditions and Facebook’s community-standards.

13. GOVERNING LAW AND DISPUTE RESOLUTION
This Promotion and any dispute arising from or in connection with it (including the Prizes) shall be governed by the laws of People's Republic of China and any dispute which cannot be settled amicably shall be submitted to the competent courts of People's Republic of China, unless otherwise provided for in mandatory legal provisions.
